Breath test with your pants down

After being picked up for doing burnouts while drink driving a Queensland man dropped his pants and told Police to stick the breathalyser mouthpiece in to his bottom. 

The Toowoomba magistrates court heard James Andrew Hunter, 26, had crashed his car after a drinking at a mates house but continued to drive with smoke pouring from the car, attracting the attention of Police. He then turned into a residential street and did a burnout, not realising the Police were watching. 

Police said, Hunter blew a roadside breath alcohol reading of 0.176 and was taken to the police station for a breath analysis test; however, when directed to supply a breath sample Hunter stood up, dropped his pants, bent over and told Police to insert the breathalyser mouth piece into his bottom. 

Hunter failed to appear in court earlier this month to answer charges but surrendered to Police on the 23rd November and appeared in custody to plead guilty to all charges. 

Mr Hunter's solicitor, Sarah Gordon, said her client was drunk on the night and did not remember much of the events.

Describing Hunter's behaviour as "deplorable", Magistrate Damian Carroll fined his $1200 and disqualified him from holding or obtaining a driver's licence for the next 6 months. Adding to that Hunter's car had also sustained over $7,000 in damage. 

Though AlcoSense recommends a Calibrated, Australian Standards Certified breathalyser a proper breath sample needs to be taken from the lungs, not from the bottom.
